NAVAYE
THE LAST RUN — LEGAL

Terms of Service

Last updated: 7 October 2026 · Effective: 7 October 2026

These Terms of Service ("Terms") are a binding legal agreement between you and Navaye, a sole proprietorship based in Gwalior, Madhya Pradesh, India ("Navaye", "we", "us", "our"), governing your access to and use of The Last Run mobile game, its pages on this website, and everything we provide through them (together, the "Service").

By downloading, opening or playing The Last Run, you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not accept them, do not play.

1.Acceptance of these Terms

You accept these Terms by any of the following: installing or opening the game, playing it, linking a profile, or buying Cans. The title screen tells you this on first launch. Acceptance is by conduct; you do not need to sign anything.

If you are under 18, or under the age of majority where you live, your parent or lawful guardian must read and accept these Terms for you, and is responsible for your use of the Service.

These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature.

2.Definitions

  • "Profile": the anonymous player profile our server creates for you on first launch, identified by a random player ID, together with everything held on it.
  • "Cans": the game’s virtual currency.
  • "Crates": the Supply Crate, Treasure Chest and Briefcase, each of which gives one random Item when opened.
  • "Items": the consumable items used in runs: Head Start, Swift Dash, Long Dash, Long Trip, Mushroom and Second Wind.
  • "Virtual Items": Cans, Crates, Items and any other virtual currency, content or entitlement in the game.
  • "Store": Google Play or the Apple App Store, whichever you obtained the game from.

3.Eligibility

You may use the Service only if you are at least 13 years old, or older where the law of your country sets a higher minimum age for using an online service without parental consent (up to 16 in parts of the European Economic Area).

If you are under 18, or under the age of majority where you live, you may play only with your parent’s or lawful guardian’s permission, and only they may make or approve a purchase.

You may not use the Service if you are barred from doing so under any applicable law, or if we have previously terminated a profile of yours for breach.

4.Your profile

There is no sign-up. On first launch the game creates an anonymous Profile, and your phone keeps the session that proves the Profile is yours. Whoever has that session, or the platform account linked to the Profile, controls the Profile.

  • Linking. You can link your Profile to Google Play Games (on iPhone, once released, Apple Game Center). If your phone is already signed in, the game links in the background. You must be signed in before you can buy Cans.
  • Restoring. To get your Profile back on a new phone, sign in to the same Play Games or Game Center account. If the new phone has already started a Profile of its own, its Cans, Crates and Items are added to your restored Profile, and nothing is lost.
  • Unlinked Profiles. If you never link your Profile and you uninstall the game, clear its data or lose your phone, the Profile cannot be recovered, and neither can anything on it. We cannot restore an unlinked Profile for you. An unlinked Profile with no activity for 2 years is deleted, together with any Cans, Crates and Items on it, as described in the Privacy Policy. Linked Profiles are kept until they are deleted.
  • Your responsibility. You are responsible for everything done through your Profile, and for keeping control of your phone and your platform account. You may not share, sell, rent or transfer a Profile, or create Profiles by automated means.

5.Licence to play

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and play The Last Run on devices you own or control, for your own personal, non-commercial entertainment. This is a licence to use, not a sale, and no ownership passes to you.

The licence ends automatically when your right to use the Service ends, and you must then stop playing and delete the game.

6.Cans and other Virtual Items

Virtual Items are licensed, not sold. When you buy, find or open a Virtual Item, you receive a limited, personal, non-transferable, revocable licence to use it in the game, under these Terms. You do not own Virtual Items, and they are not your property.

  • No cash value. Cans and other Virtual Items are not money, do not earn interest, and have no value outside the game.
  • Not transferable or redeemable. They cannot be transferred, gifted, traded, sold or exchanged for money, goods or anything else, and we will never redeem them for real money. Any attempt to do so outside the game is void and a breach of these Terms.
  • Non-refundable. Except where the law or the Store’s refund policy requires otherwise, Virtual Items are non-refundable, including when they are unused, when you stop playing, when you delete your data, or when your Profile is suspended or terminated for breach.
  • Held on our server. Your balance is the one our server holds. The copy on your phone is a cache, and if the two disagree, our server’s record wins.
  • We may change them. We may change prices in Cans, crate contents and odds, item effects and any other aspect of Virtual Items, or remove a Virtual Item, for example to keep the game balanced. We give notice in the game where the law requires it, and the Shop always shows current prices and odds before you buy. Except where the law requires otherwise, a change does not entitle you to compensation.
  • Errors. If a Virtual Item is credited to you by mistake, through a fault in the game or our server, or through a purchase that is later reversed, we may correct the balance.

If we discontinue the game, Virtual Items end with it; see "Suspension and termination".

7.Buying Cans

Cans are sold in packs as in-app purchases at the prices shown in the game, in your Store currency, inclusive of any taxes the Store collects.

  • The Store sells, not us. Purchases are made through Google Play (and, once the iOS version ships, the Apple App Store), under the Store’s terms and payment methods. We never receive your card, UPI or bank details. We use RevenueCat to process purchases on our behalf.
  • Sign-in first. You must link your Profile to Play Games or Game Center before you can buy Cans, so a paid balance can always be restored.
  • Delivery. Cans are credited by our server once it has confirmed the purchase. This normally takes seconds but can take longer if the Store, RevenueCat or the network is slow, or while a payment awaits approval. A delay is not a failure; if Cans have not arrived, use Restore purchases in the Shop or Settings, or contact us.
  • Prices. We may change pack prices and sizes. A change does not affect a purchase you have already completed.
  • Consumable purchases. Cans packs are consumable, one-time purchases, not subscriptions. Nothing renews.

8.Refunds

We do not issue refunds ourselves. Because the Store is the merchant, any refund request must be made to the Store under its own refund policy and time limits, for example Google Play’s refund policy. We cannot issue, compel or reverse a Store refund.

Refunded purchases are taken back. If a Store refunds, reverses or charges back a purchase, we remove the Cans that purchase added from your Profile, up to the Cans it still holds. Repeated refunds of Cans that were already spent, or other abuse of refunds, is a breach of these Terms.

If you were charged in error or something went wrong, write to us at [email protected] with your Store order number, and we will help with your request to the Store.

Nothing in this section limits any right you have that cannot lawfully be excluded, including under the Consumer Protection Act, 2019 or the consumer law of the country you live in.

9.Crates and their odds

Each Crate gives exactly one random Item when opened. The result is drawn by our server from that Crate’s drop table at the moment you open it; nothing on your phone decides it, and we do not change the result for any particular player.

  • Odds are disclosed before you buy. Tap the ⓘ next to a Crate’s price in the Shop to see every Item it can give and the chance of each. The chances shown come from the same table every opening uses.
  • Buying Crates. Crates are bought with Cans in the Shop. The Briefcase is available only from the Shop.
  • Finding Crates. Supply Crates, and rarely Treasure Chests, can also be found in runs. The number you can find each day is capped. Crates you find are kept even if the run ends in death.
  • Checks. A Crate found in a run is credited only after our server accepts the run report, checking it against the run’s distance and time and the daily cap. A report that fails these checks is not credited.

We may change drop tables, odds and caps under "Cans and other Virtual Items"; the Shop always shows the odds in effect before you buy.

10.Items and how they are used up

Items are consumables. You pack up to three in your bag before a run, and an Item is used up only when it does something:

  • Head Start, Swift Dash, Long Dash and Long Trip are used up when the run starts.
  • Mushroom is used up each time you tap its button.
  • Second Wind is used up only when it fires and saves you from a death.

Mushrooms and Second Winds that did not fire go back to your bag after the run. A used Item is gone and is not replaced, even if the run ends soon after. Items can be packed and used offline; their use is sent to our server the next time you are online.

11.Fair play and acceptable use

You must play fairly and lawfully. You must not, and must not help anyone else to:

  • Cheat, or use any bot, script, macro, emulator, modified client or other tool that automates play or gives an unfair advantage.
  • Tamper with, modify, repackage, reverse engineer, decompile or disassemble the game, or extract its code, keys, credentials or assets, except to the narrow extent such a restriction is unenforceable under applicable law.
  • Alter, fake or replay data the game sends to our servers, including run reports, item use, purchases or platform proofs.
  • Exploit bugs, errors or design flaws in the economy, for example to duplicate Cans, Crates or Items, to get Virtual Items without paying, or to get around the daily cap. If you find such a flaw, tell us at [email protected] instead.
  • Buy, sell, trade or transfer Profiles or Virtual Items outside the game, or offer to do so.
  • Access or try to access another player’s Profile, or our servers, other than through the game as designed.
  • Probe, scan or test the vulnerability of the Service, breach or get around any security or rate limit, or impose an unreasonable load on it.
  • Use the Service for anything unlawful, or in breach of the Store’s or the platform’s terms.

We judge run reports and other data for plausibility, and may refuse, reverse or correct anything that results from a breach of this section, including removing Virtual Items gained through it. We may investigate suspected breaches, and may preserve and disclose information where we believe in good faith it is necessary to comply with the law, enforce these Terms, or protect the rights, safety or property of any person.

12.Availability, offline play and updates

We aim to keep the Service available, but we do not promise any level of uptime, and it may be unavailable for maintenance, upgrades, provider failures or reasons outside our control.

You can run without a connection, and pack and use Items you already hold. The Shop, buying Cans, opening Crates, seeing the odds, linking and restoring a Profile, and Delete my data need a connection. Items used and Crates found offline are sent to our server when you reconnect, and the server’s answer is final: a find it does not accept is not credited.

We may add, change, restrict or remove features. Where a change materially reduces something you paid for, we will give reasonable notice in the game. We may require you to update to a supported version to keep using online features; older versions may stop working.

13.Ads and security checks

From version 0.4.0 the game shows ads through Google AdMob: a banner, an optional ad you can choose to watch once per run to keep running after you die, and an occasional ad between runs. Watching an ad is always your choice where a reward is offered. We do not choose or endorse the ads, and we are not responsible for the products and sites they promote. Do not click or tap ads in order to generate revenue; that is not permitted. We do not promise that an ad will be available at any moment.

The game also runs security checks from Talsec. If a check reports that the copy of the game has been tampered with or is being hooked, the game will not start. If it reports an unofficial install source, a debugger or an emulator, purchases and crate opening are paused on that device and the rest of the game still plays. This is part of "Fair play and acceptable use".

What data the ads and the security checks involve is set out in the Privacy Policy, under "Ads and security checks".

14.Intellectual property and third-party licences

The Service, including The Last Run and Navaye names, logos, design, artwork, sound, text and software, is owned by Navaye or its licensors and protected by Indian and international intellectual property law. All rights not expressly granted are reserved.

The game includes third-party works, such as fonts, sounds, models and open-source software, used under their own licences. Attributions and notices required by those licences are listed in the game under Settings → Credits. Those licences govern your use of the works they cover, and nothing in these Terms limits the rights they give you.

If you send us feedback, suggestions or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction, attribution or compensation.

15.Third-party services

The Service relies on third parties, including Google (Google Play, Play Billing, Play Games Services and the AdMob advertising service), Apple (App Store and Game Center, once the iOS version ships), Supabase, RevenueCat and Talsec (security checks). Those services are governed by their own terms and privacy policies, not ours.

We are not responsible for the availability, accuracy, security or acts of any third party, and a failure, outage or policy change on their side is not a breach of these Terms by us.

Google and Apple are not parties to these Terms, have no obligation to provide support for the game, and are not responsible for any claim relating to it, except as their own Store terms require.

16.Suspension and termination

By you. You may stop playing at any time, and delete your data with Settings → Delete my data or as described at navaye.com/the-last-run/delete-account. Deleting your data removes your Profile and every Virtual Item on it, permanently and without refund.

By us. We may suspend or terminate your access to all or part of the Service, or remove Virtual Items gained in breach, if we reasonably believe that:

  • you have breached these Terms, particularly "Fair play and acceptable use";
  • your use exposes us, another player or any person to legal liability, security risk or harm;
  • a purchase has been refunded, reversed or charged back in circumstances that amount to abuse; or
  • we are required to do so by law, or by Google or Apple.

Where the breach can be put right and the risk allows, we will tell you what is wrong and give you a reasonable chance to fix it first. Where it cannot, we will not. Termination for breach does not entitle you to any refund.

Ending the game. We may discontinue the Service entirely. If we do, we will give at least 30 days’ notice in the game or on this website, and we will stop selling Cans when we give that notice. When the Service ends, Virtual Items end with it, and unused Cans are not refunded except where the law requires.

17.Disclaimers

The Service is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement.

Without limiting that, we do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that progress, Profiles or Virtual Items will never be lost.

You further acknowledge that:

  • Health. The game contains horror themes, flashing lights and fast camera movement. Some people may have a seizure when they see flashing lights or patterns, and fast motion can cause motion sickness. Read the health warning shown when the game starts, use Reduce motion in Settings if it helps, and stop playing if you feel unwell.
  • Play safely. Do not play while walking, driving or doing anything else that needs your attention.
  • Randomness. Crate results are random. Opening a Crate does not guarantee any particular Item, however many Crates you open.

Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded.

18.Limitation of liability

To the fullest extent permitted by law, and regardless of the form of action:

  • We will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of profit, revenue, goodwill, opportunity, data, progress or Virtual Items, even if we were advised such loss was possible.
  • Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amount you actually paid for Cans in the twelve months immediately before the event giving rise to the claim, or ₹5,000 (five thousand Indian Rupees), whichever is lower.
  • If you have paid nothing, our aggregate liability is limited to ₹1,000 (one thousand Indian Rupees).

These limits apply in aggregate across all claims, not per claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, or death or personal injury caused by our negligence, or your statutory rights as a consumer.

Any claim must be brought within one year of the date on which the cause of action arose, failing which it is permanently barred, except where a longer period is mandatory under the Limitation Act, 1963 or other applicable law.

19.Indemnity

To the extent permitted by law, you will indemnify and hold harmless Navaye, its proprietor, employees, contractors and service providers from and against all claims, losses, liabilities and costs (including reasonable legal fees) arising out of your breach of these Terms or of any law, or your misuse of the Service.

This indemnity survives termination.

20.Force majeure

We are not liable for any failure or delay in performing caused by events beyond our reasonable control, including natural disaster, epidemic, war, terrorism, civil unrest, strike, fire, flood, power or telecom failure, internet outage, cyber-attack, failure of a third-party provider, or any act, order or restriction of a government or regulator.

21.Notices and communications

Because we do not collect your contact details, we give notice in the game or by a posting on this website, and such notice is effective when shown or posted.

You must send notices to us at [email protected], and they are effective on our acknowledgement or two business days after sending, whichever is earlier.

22.Changes to these Terms

We may amend these Terms. The "last updated" date at the top always reflects the current version, and the current version is the one that governs.

For material changes we will give at least 14 days’ notice in the game before they take effect. For changes that are immaterial, that correct errors, or that are required to comply with law with immediate effect, the amended Terms apply as soon as they are posted.

If you do not accept an amendment, your remedy is to stop playing before it takes effect. Continuing to play afterwards means you accept it.

23.Governing law, arbitration, and jurisdiction

These Terms and any dispute arising out of or relating to them or the Service, whether in contract, tort or otherwise, are governed by the laws of India, without regard to conflict-of-laws rules.

Good-faith resolution first. Before commencing any proceeding, the parties will attempt in good faith to resolve the dispute by written notice and discussion for 30 days.

Arbitration. Any dispute not resolved in that period will be referred to and finally resolved by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996 and any statutory amendment or re-enactment of it. The seat and venue of arbitration is Gwalior, Madhya Pradesh, India, the language is English, and the award is final and binding. Each party bears its own costs unless the arbitrator directs otherwise.

Individual basis only. Disputes will be resolved individually. Neither party may bring a claim as a plaintiff or class member in any purported class, collective or representative proceeding.

Courts. Subject to the arbitration agreement above, the courts at Gwalior, Madhya Pradesh, India have exclusive jurisdiction over all matters arising out of these Terms, including applications for interim relief in aid of arbitration.

Nothing in this section affects any right you have to approach a consumer forum under the Consumer Protection Act, 2019, or the Data Protection Board of India under the Digital Personal Data Protection Act, 2023. If you are a consumer living outside India, you also keep the protection of the mandatory provisions of the law of the country where you live, and where that law gives you the right to bring proceedings in your local courts, nothing in this section takes that right away.

24.Grievance redressal

In accordance with the Information Technology Act, 2000 and rules made under it, complaints about the Service may be addressed to our Grievance Officer:

Grievance Officer
Navaye (sole proprietorship)
Gwalior, Madhya Pradesh, India
Email: [email protected]

We acknowledge complaints within 24 hours and endeavour to resolve them within 15 days of receipt. Please include a clear description of the issue and, for a purchase, the Store order number.

25.General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service, and supersede every prior understanding about it. The Store’s own terms also apply to your purchases.
  • Severability. If any provision is held invalid or unenforceable, it is to be modified to the minimum extent necessary to make it enforceable, or, if that is not possible, severed. The rest remains in full force.
  • No waiver. A failure or delay in enforcing any provision is not a waiver of it.
  • Assignment. You may not assign or transfer these Terms or any right under them. We may assign them to a successor in connection with a merger, acquisition or sale of the business, on notice to you.
  • Survival. The sections on Virtual Items, refunds, intellectual property, disclaimers, limitation of liability, indemnity, governing law and this General section survive termination.
  • Third-party rights. Except as stated for Google and Apple, no one other than you and us has any right to enforce these Terms.
  • Language. These Terms are drafted in English. Any translation is provided for convenience only, and the English version prevails in the event of a conflict.
  • Headings. Headings are for reference only and do not affect interpretation.
